SHOPPING REGULATIONS

I. General terms and conditions.

  1. The online shop www.piernikowysklep.pl is managed by Aha-menes Magdalena Mroczek based in Koczargi Stare, Akacjowa 69. It sells products of Kopernik Confectionery Factory Ltd. as well as other supplementing products. The supplementing products are sold in sets together with standard offer products ( produced by Kopernik Confectionery Factory Ltd. )
     
  2. Using our service means you agree to comply with all its regulations.
     
  3. Placing an order in the Shop ("Order") by a service user ( "Customer") in a way descibed in entries no 9, 10 and 11 below and Order approval by the Shop through a Notice (as defined below) means signing a trade agreement between the Customer and Aha- Menes Magdalena Mroczek, based on terms and regulations of Civil Code and this Regulations (“Agreement”).
     
  4. The sales  agreement is drawn up between the Customer and Aha-Menes Magdalena Mroczek.
     
  5. The Shop sells Products by means of the Internet.
  6. The parties can withdraw from the Agreement completely or partly in the way defined in entry no 13 below. In case of partial or complete Agreement withdrawal, the Agreement is deemed invalid in whole or in part.
     

II. Orders.

  1. The shop accepts Orders from www.piernikowysklep.pl
     
  2. Orders can be placed during the period of Service activity. The Seller has the right to suspend orders execution on Saturdays, Sundays, holiday period or bank holidays. The information about orders suspension will be published on the Website,. 
     
  3. To place an order it is necessary to register by filling in the registration form, available on the Website. The registration allows the Seller to get data needed for Sales Agreement, as well as prevent delays in future orders.
     
  4. The Customer places an order through:

    1. Choosing a product and putting it in the “basket “, by clicking on the button next to the Product description
       
    2. Clicking on the “ Pay” button int the “basket”
       
    3. Entering correct data in the order form (“Order form”): (I) shipment address, (II) payer details, (III) payment method and
       
    4. Confirming your choice by clicking on “Order”
       
  5. After placing an Order, the Shop will immediately send the Customer an e-mail confirming getting the Order ( “Order Notice”). The Notice will be sent to the address entered in the Form. The notice will contain: (I) Product name and its description, (II) Product price, (III) total price of the ordered Products.
     
  6. The Shop accepts the Order for execution the moment when:
    1. Authorisation of payment is sent from a PayU service to the Shop, in case of payment by a “credit card” or “bank transfer”,
       
    2. The Shop receives a money transfer to its account, in case of “normal transfer”
       
  7. The Order will be executed in the fixed period on condition that the Product is in stock, or available in “Kopernik” Confectionery Factory Ltd. or at supplier's of elements supplementing the offer.
     
  8. When the Ordered Product is not in stock or unavailable at the producer’s or supplier's, the Customer is immediately informed- in the period defined for the Order- about the unavailability of the Product in an e-mail ( “Order Status Notice”). After receiving this message, the Customer makes a decision concerning further Order execution ( partial resignation from the Order, extended waiting time, Order cancellation). If the Customer does not inform the Shop about the decision within 5 days from receiving The Order Status Notice, The Order is cancelled in part which cannot be executed by the Shop. In the case mentioned above or in case of order cancellation in whole or in part, it is agreed that the Customer has withdrawn from the Agreement in part. If the Customer has resigned from the whole Order, it means terminating the whole Sales Agreement .
     
  9. In case of products on promotion or on sale, the Orders will be executed according to the queuing them in the Shop. The Offer is valid until Products in stock last/
     
  10. We issue an invoice for every Order. The Invoice is issued when the Ordered Products are ready for shipment to the Customer.
 

III. Pricing policy

  1. The Product prices are quoted in Polish zlotys and they include „VAT”. The price quoted next to each Product (“Price”) is binding the moment it is confirmed in the Order Confirmation Notice. Subject to entry no 19 below, shipment charges will be added to the Price. Procedures stated above are binding in case when because of Poczta Polska or courier companies regulations the Order cannot be executed in one shipment, but in two ore more.
     
  2. The Shop has the right to change the Product prices on offer, introduce new Products into the Offer, introduce and cancel promotions on the Shop website or make changes in the offers.

IV. Delivery and product receipt.

  1. Ordered goods are delivered to the Customer by: courier companies (courier mail) or Poczta Polska ( priority mail), it is also possible to collect the products personally in our stock or use Shop delivery within Warsaw. In case when goods are not collected by the Customer, they can receive it in the ways mentioned above or collest it personally ( according to entries 24 or 25 below), however, the Customer will cover the charges of the previous and present shipment.
     
  2. Subject to procedures defined in the second sentence entry 19 above, goods delivery is made in the form chosen by the Customer in the delivery Form, to the address entered there.
     
  3. Order execution time is quoted with each Product. It includes working days ( Saturdays, Sundays and holidays are not counted), execution period means the time from placing the Order till its shipment. If the Order includes goods which are quoted different executions times, the shipment of all Products takes place after collecting the whole set, this means after the longest execution time quoted with the Product.
     
  4. Delivery time of the Ordered Products equals execution time, which is mentioned in p.12-14 above, extended in case of shipment performed by sides mentioned in p.19 above (“Delivery time”). 
     
  5. When filling in the form, the Customer can choose personal collection option . In this case, the goods will be collected from Aha-Menes stock. The collection can be realized from Monday to Friday from 9. 00 to 17.00. The person entitled to collect the goods in case of choosing “ Down pay” option must have a print of the Order and Order Notice.
     
  6. Within Warsaw area it is possible to arrange shipment with Aha-Menes transport according to the fixed prices. Delivery dates will be fixed individually, depending on the queue of orders.
     
  7. The Customer has the right to check the goods in the presence of a courier, Poczta Polska worker, Shop’s driver. Customer’s signature on the shipping document states that the Delivery is in accordance with the Sales Agreement.
     
  8. In case of Customer’s absence in the place and at the time stated in the Order, The Customer will have to cover the charges of additional Delivery.

V. Discounts and reductions

  1. Regular Customers can obtain discounts and reductions for goods available in the Shop. Terms and conditions of allowing discounts and reductions are published on the Website.

VI. Payment

  1. The Customer chooses the payment method.
     
  2. The Customer can choose the following payment methods:
    1. Pre payment from PayU:
      • Internet payment - credit card
      • bank transfer
    2. Cash
      • on personal collection from the main stock or collecting point
      • cash on delivery in case of post and courier mail in Poland ( gross value of the transaction cannot be over 1000zl).
         
    3. Regular transfer.

VII. Returns and complaints

  1. If the Customer notices any mechanical damage after receiving the Products, they should:

    • in case of delivery within Warsaw area by Koliber express, please read courier company regulations which is available on www.koliberexpress.pl, where conditions of making a complaint are defined.
       
    • in case of courier mail in the country and abroad by DPD Poland, please read the conditions of domestic and international services available on www.dpd.com.pl ( shipment bookmark), where information about complaints are defined.
       
    • in case of post mail, please read Poczta Polska Regulations available on www.poczta-polska.pl ( Main Page> Services> Post Legal Acts> Regulations), where conditions of making a complaint are defined.
       
  2. The Shop does not accept any COD mail. Costs connected with returning faulty products are returned by the Shop after it receives the mail and considers the complaint. The Customer has to attach Vat invoice as well as the “ complaint form”.
     
  3. All complaints concerning the quality of the goods, will be considered according to procedures applied by the producer or suppliers of the faulty goods, no later than 30 days since the day of receiving the complaint. Damaged good will be exchanged or if it is impossible (e.g because of its unavailability in stock or at the producer and suppliers), the Shop will return the counter value of the Product Price or offer other Product.
     
  4. The buyer has the right to make a complaint of food products within 3 days since the opening of the package (packed goods). A notice about incompatibility of the product with the sales agreement should be issued no later than the products best before date. After this period, Customer’s demands are considered ill-founded. 
     
  5. The buyer orders goods taking into consideration weather conditions and delivery form. The shop is not responsible for goods damage resulting from high temperature. However, in summer season, there is a notice warning about the possibility of chocolate products damage.
     
  6. The shop is not responsible for agreement executions problems caused by major force or administrative actions. The Seller is not to blame for damage connected with inability to use the Shop website by the Customer, or damage resulted from: wrong activity, errors, lacks, defects, delays in operation or transfer, computer virus, line or system failure. Specifically, the Seller is not responsible for damage caused by technical disturbances of electronic mail, resulting from incorrect parameters and settings of the equipment or network operators activities.
     
  7. All damage resulting from incorrect and inconsistent with the Regulations ways of placing an Order by the Buyer, incorrect data in the registration form, incorrect delivery address, are Customer’s responsibility.

VIII. Photos and products descriptions

  1. Products descriptions and photos are the property of Aha-Menes Magdalena Mroczek. Any use of the materials for commercial purposes is banned.
